Right to Know Law
(Pennsylvania Act 3 of 2008, effective January 1, 2009)
Procedures for requesting public records from the Authority
The West Hills Area Water Pollution Control Authority intends to be in full compliance with the provisions of the New Pennsylvania Right to Know Law.
1. Procedure for requesting public records:
A. The request must be made in writing by either hand delivery, U.S. mail or fax. Applications are available from the Authority office at 257 Linde Road, Kittanning.
B. The requestor must identify himself or herself by name, address and phone number.
C. The requestor must be a legal resident of the United States.
D. The requestor must specify to whom the response should be sent, including address.
2. The five (5) day review period shall begin at the date and time that the request is received in the Authority office during regular office hours. All requests received after regular office hours shall be deemed to be received at the beginning of regular office hours on the next following business day.
3. In certain allowable circumstances (exceptions), the response may be extended to thirty (30) days beyond the initial five day period. In such case, the requestor will be notified of the delay and the reason thereof.
4. The request of documents shall require a specific description of the documents requested. Response to the request will be made by U.S. Mail, or by requestor pickup (if requested).
5. The documents requested must fall within the scope of the requirements of the law.
6. Certain documents are exempt from public access pursuant to Section 708(b) of the Act. In the event that the Authority determines that requested documents are exempt from disclosure, the authority will so advise the requestor citing the specific section(s) of the law creating the exemption.
7. There will be a fee of $0.25 per page copied. If certified copies are requested, the requester will be charged $5.00 per copy for the certification. Additional fees may be assessed in accordance with the Act.
8. The fee for supplying copies of requested public records must be paid by cash or check prior to the release of the copies. If the fees to fulfill a request will exceed $100.00, the estimated costs must be prepaid.
